Defended and Undefended

Once the debtor has been served with a summons, they have 10 court days to serve and file a notice of intention to defend. If the debtor serves and files a notice of intention to defend within the 10-day period, the matter will be regarded as defended. However, if the debtor fails to serve a notice of intention to defend within the prescribed time period, the matter will be deemed “undefended”.
